Spouse & Partner Visa UK – Frequently Asked Questions (2025)

1. What is a UK Spouse or Partner Visa?

A UK Spouse Visa (also called a Partner Visa) allows a British citizen or someone with settled status (e.g. ILR) to sponsor their spouse, civil partner, or unmarried partner to live with them in the UK under Appendix FM of the Immigration Rules.

2. Who can apply for a UK Spouse or Partner visa?

You may apply if:

  • You are married, in a civil partnership, or have lived together for at least 2 years in a genuine and subsisting relationship

  • Your partner is a British citizen or holds indefinite leave to remain (ILR) or EUSS settled status

  • You plan to live together permanently in the UK

  • You meet the financial, accommodation, and English language requirements

3. What is the financial requirement for a UK Spouse Visa in 2025?

As of 11 April 2024, the UK sponsor must earn a minimum of £29,000 gross per year to meet the financial requirement.

📌 This threshold applies to all Spouse/Partner Visa applications, whether submitted inside or outside the UK. It is no longer based on whether children are included.

4. How can I meet the financial requirement?

You can meet the £29,000 requirement through:

  • Employment or self-employment

  • Pension income

  • Rental income or dividends

  • Cash savings (see the separate savings FAQ below)

  • A combination of income and savings (in some cases)

5. What if my sponsor receives benefits?

If your UK sponsor receives certain public funds (such as Disability Living Allowance, PIP, or Carer’s Allowance), you may be exempt from the £29,000 rule. Instead, you must prove adequate maintenance.

6. Can I work in the UK on a Spouse Visa?

Yes. A Spouse or Partner Visa gives you full rights to work, study, or be self-employed in the UK from the day your visa is granted.

7. How long is a Spouse Visa valid for?

  • From outside the UK: 2 years and 9 months

  • From inside the UK (switching): 2 years and 6 months
After 5 years on this route, you may apply for Indefinite Leave to Remain (ILR).

8. Can I switch to a Spouse Visa from within the UK?

Yes, if:

  • You're not on a visitor visa or a short-term category (unless exceptional circumstances apply)

  • You meet all eligibility requirements
You may switch from other visas such as student, skilled worker dependent, or family life. We can help assess your case and advise on the best solution.

9. What documents do I need to apply?

Typical documents include:

  • Valid passports

  • Marriage or civil partnership certificate (or proof of cohabitation)

  • Payslips and bank statements

  • Employment letter

  • English language certificate (minimum A1)

  • Proof of accommodation

  • Evidence of a genuine relationship (photos, messages, travel, etc.)

10. What if my Spouse Visa is refused?

If your application is refused, you may:

  • Appeal on human rights grounds

  • Submit a Pre-Action Protocol (PAP) letter

  • Reapply with corrected evidence
We can help assess your case and advise on the best solution.

UK Spouse Visa – Savings Route FAQ

1. Can I apply using savings instead of income?

Yes. If you or your partner don’t meet the £29,000 income requirement, you may qualify using cash savings held for at least 6 months.

2. How much savings are needed in 2025?

To meet the requirement through savings alone, you must have £88,500 in cash savings.

Formula: £16,000 baseline + (2.5 × £29,000) = £88,500

3. What are the rules for cash savings?

  • Must be held by you, your partner, or jointly

  • Funds must be held in a personal account (not business or tied up in assets)

  • Must have been held for at least 6 consecutive months

  • Gifted or inherited funds are allowed, if held long enough

  • Money must be accessible and not subject to penalties or fixed terms

4. Can I combine savings with income?

Yes. If your income is below £29,000, you can offset the shortfall with savings.

For every £2.50 shortfall, you’ll need £1 in savings to compensate.

5. Is using savings risky?

No — but strict documentation rules apply. Missing bank statements, incorrect timeframes, or account types can lead to refusals. It's strongly recommended to seek professional help when using this route.
