ILR APPLICATIONS

If you have resided in the UK for a qualifying period under an immigration category that allows for settlement, you may meet the criteria to apply for Indefinite Leave to Remain (ILR).

Upon obtaining ILR status, you are no longer subject to any restrictions on your residence in the UK, allowing you to work, study, or conduct business without limitations. Additionally, ILR serves as a necessary step for those seeking to pursue British citizenship.

The majority of applications for ILR are made through pathways that necessitate five years of lawful residency and status in the UK. To qualify for Indefinite Leave to Remain, you must have maintained continuous residence in the UK for a period of five years on a valid visa. After this duration, the following visas may be eligible for ILR:

· Skilled worker visa or Tier 2 (General) visa

· Minister of Religion T2 visa or Tier 2 (Minister of Religion) visa

· Sportsperson T2 visa or Tier 2 (Sportsperson) visa

· Business visas, such as the Turkish Worker or Businessperson Visa

· Global Talent Visa (in certain circumstances)

· Scale-up Visa

· Innovator Visa

· Tier 1 (Entrepreneur) Visa

· Family members, including spouses, parents, children, and dependent adults

· Tier 5 (Temporary Worker - International Agreement) visa

· Ancestry visa

ILR Requirements & Eligibility:

Completion of a continuous period of lawful residence in the UK does not automatically grant you ILR status.

You must apply for ILR to UKVI for assessment. Along with your application, you will be required to provide evidence demonstrating your eligibility for ILR, including:

· Continuous lawful residence in the UK for the required qualifying period

· Absences from the UK not exceeding 180 days in any 12-month period of the qualifying period

· Proof of passing the Life in the UK Test

· Evidence of your English language proficiency meeting the necessary standards

· Documentation addressing the General Grounds for Refusal, such as any criminal convictions or breaches of immigration status, to ensure compliance with immigration regulations.

Before applying for ILR, it's essential to understand the requirements thoroughly and evaluate the prospect of success. If there are concerns, consider whether it's worthwhile to request the Home Office's discretion in your favour.
